DoviApp is a trademark of Rent Buy Sales LTD (https://www.rentbuysales.com).
1. Generalities
1.1 The Contract between DoviApp and the Workers appearing on the DoviApp shall come into effect from the Day 1 of the worker’s registration.
1.2 The Contract shall remain in force until the Worker has been removed from the DoviApp mobile Application and:
- All the pre-booked Services have been completed; and
- All the Charges have been paid.
2. Services and Obligations
2.1 As a general norm, Services should be provided with reasonable care and skill by Worker, within a reasonable time if no specific time has been agreed, or at the stated time and for a reasonable cost.
2.2 The Worker shall provide the Services to the Customer in accordance with these Terms and Conditions.
2.3 The Worker shall provide the Services according to the standards of skill and care reasonably expected, according to the local practices.
2.4 If the Customer believes that any element of the Services does not meet the reasonable standards, then the Customer must promptly notify DoviApp and allow an investigation to take place.
2.5 The Worker shall comply with all reasonable requests and directions of the Customer in relation to the Services.
2.6 As applicable, the Customer shall:
- Ensure that he has all permits required to undertake any task being done by the Worker inside the Premises or on any property;
- Provide to the Worker access to the Customer Premises or property as is reasonably required by the Worker for the provision of the Services;
- Ensure reasonable supervision of the Worker during the time of execution of the work and whilst they are in the Customer Premises or handling the property.
2.7 The Worker shall comply with all reasonable health, safety and security rules, regulations and requirements advised by the Customer and by DoviApp.
2.8 The Worker shall use all reasonable measures to secure any means of access to the Premises, supplied by the Customer for the purpose of enabling the Worker to undertake his work at the Customer Premises.
2.9 Whenever possible (e.g. delivery services are available in the served area), Worker should procure materials from the DoviApp store.
2.10 Any goods provided in line with the contract should be as pre-agreed between Worker and Customer, of satisfactory quality, and fit for the purpose made known.
3. Cost Estimate
3.1 Any quotes or estimates provided by The Worker to the Customer are estimates only and cannot be guaranteed beyond three days.
3.2 The price given by the Worker must be a true estimate of what the Customer expects. If there are circumstances the Worker could not have been aware of, that will affect the price and the Worker will provide you with an updated estimate.
3.3 The Worker shall substantiate the rationale behind the charges imposed to a customer.
3.4 Quotations are valid for three (3) days from the date of the quotation.
3.5 Payment from the Customer will be required for any work that has been authorised and has been completed up to the point of completion or termination, based on the case.
4. Charges and Payments
4.1 DoviApp rates are available in real time directly from the Application Menu. These rates are subject to change without any notice. The customer who has made a booking is deemed to know and agree with the rates that DoviApp practices.
4.2 The customer can pay the Charges using any of the payment method or mode offered on DoviApp.
4.3 The Worker performing the Services must obtain from the Customer a consent before performing Services that result in any estimate of time-based or flat-rate Charges given to the Customer.
4.4 DoviApp will issue a receipt for any transaction made via the Application at the time of Payment.
4.5 The Customer must pay the Charges due to DoviApp before the completion of the Work using any of the payment methods available on DoviApp.
4.6 If the Customer does not pay any amount properly due, DoviApp will apply penalties potentially attaining GHS 500 for the extra processes that may be required. Bank interest rate for delayed payment may be added on top of this amount.
4.7 Staged payments can be agreed under exceptional circumstances. Such agreement must be made beforehand, and payment dates will be stipulated on your contract.
5. Work duration and Delays
5.1 Worker and Customer agree to take all reasonable means to be on time for any scheduled meeting.
5.2 DoviApp aims to process all of customers’ requests in a timely manner, during the normal office hours. Requests received outside the normal working hours will be processed on the following workday.
5.3 A work started by a Worker should be completed within the agreed timescale. The Worker shall take all necessary precautions to ensure this.
5.4 Worker or Customer shall not be excused for failure or delay in executing their responsibilities resulting from general economic conditions or other general market effects, including traffic jams.
5.5 A party (i.e. Worker or Customer or DoviApp) shall not be liable for any failure of or delay in the performance of a job for the period that such failure or delay is due to force majeure event (i.e. beyond reasonable control, materially affects the performance of an obligation, and could not reasonably have been foreseen or provided against).
6. Changes
6.1 Changes to the contract may also mean changes to the price and this will need to be confirmed in writing or other durable form and agreed by both parties.
6.2 Where changes or variations to the original agreement between Worker and Customer occur after work has commenced, acceptance of such changes may be made between both parties orally, face to face or via the telephone where time is of the essence and to stop work to gain written consent would result in further, unnecessary delays. In such cases, Worker will document these changes in the summary of Work to be filled after completion of the assignment.
7. Complaints and dispute resolution
7.1 The Worker will be liable for any damage that has been caused as a result of the work done.
7.2 DoviApp team will only be liable to damage caused by our negligence.
7.3 If a problem arises. DoviApp aims to resolve the issue within a reasonable time.
7.4 DoviApp is committed to providing the highest levels of care to all customers. If the Customer is in any way dissatisfied with the Worker’s services, then please let DoviApp know about it. This will help DoviApp to continually improve their service to the Customer.
7.5 In the unlikely event that the Customer is dissatisfied, the Customer could submit a Claim to DoviApp no more than seven days after the completion of the work by the Worker.
7.6 DoviApp will acknowledge receipt of the Customer’s complaint and undertake an investigation.
7.7 The Worker and the Client shall agree to the outcome of the investigation. This means that the Worker should agree to undertake any corrective action requested by DoviApp at no expense to the Client or DoviApp. Such corrective action must be satisfactory and completed in a timely manner.
8. Cancellation
8.1 DoviApp may terminate without notice the registration of a Worker if a serious breach to this contract has been committed.
